This might get ugly
Just
to give you guys a heads up I am having major probs with Apex, I am
sure you all know how bad they have messed up the cobra with in the
last couple months and how many times it has broken down leaving there
shop because of all the coolant system work they have failed to fix.
Well not my head gasket blew because of all the over heating issues
from APEX, and it is there fault this has happened and Mike took full
responsibility for it yesterday on AIM, I also had Jesse there with me
when I told mike as a witness.
Today I called him to talk more about when they were going to fix the
car and now he is trying to say this is all my fault and when the
Canton tank blew that's what cause the head gasket to go even though
Canton has reports of a bad batch of tanks that the weld broke and that
also when this happened I shut down the car before it even had a chance
to over heat.
So 4 times attempting to pick up the car it brakes down on the way home
due to there work. 3 times it over heated, the last was there mech not
putting the upper radiator hose on properly and I was forced to fix it
in a parking lot and then tried to take it home and it over heated and
broke down on me.
They claimed the did a pressure test of the block.. well if they did
they would of found the leak.. so that was a lie. Plus the Canton tank
has a 16psi cap on it that would of blown before anything else on the
car would of gone. So there was no "extra pressure" Mike is now
claiming is the reason.
So it looks like he is going to try and make me pay for some of the
repairs that were the shops fault because he doesn't want to pay to
have the engine pulled and replace the gaskets.
So I told him I should not be help responsible for this and he tried to
argue with me saying he shouldn't have to pay. Claims he didn't charge
me to repair the canton tank. (Which I was never told) But that I
pointed out the over heating started after the replaced the radiator
not when the canton tank went.
I hate to say this but this looks like it might go to court for his shops shady work. Will find out more later.
My last statement to him before he got off the phone was "Mike I
understand I have received discounts for being sponsored by the shop
but I wont pay for something that was not my fault or your fault but
the half ass work that was done on the car by the mech"

Well
I believe small claims is for claims up tp $5000... You just need to
document what was done when, and what specific problem occured
afterwards, and what had to be fixed because of it... Maybe he'll
change his mind if he realizes your serious about taking him to court,
he can't really afford bad publicity...

true, I haven't brought this up to him yet because I am trying to avoid
a battle and you guys think when I get upset I vent.. That guy will
make a war out of this.

If possible communicate in writing (email, IM) and be VERY careful how
you say things, then you can print them out for hard evidence...

This
is the PM I just sent him, and I have also done some home work in the
last few hours and was told since they did not have me sign a work
order I can turn them into the B.A.R (Bureau of Automotive Repair) if
this gets ugly or Mike tries to get shady.
The Cobra
I have a feeling that after yesterday you took full responsibility for
this and I also believe that if a proper pressure test was done this
leak would of been found.
I also think your going to make this difficult and force me to pay out
of my pocket for some of the cost of damages not my fault. I know your
going to use things like "boost or the canton tank". if that is the
case i don't feel like battling this out, or taking this to levels it
shouldn't have to go. We have been friends for awhile and I don't feel
our friendship should be affected since your not the one who worked on
the car but protecting your shop and the cost to fix the car.
So I would like to request you figure out what the cost would be to
complete this project, tell me what my cost is and write me a check for
Apex's part and I am going to take it to a local repair shop to have
the car fixed.
Sorry but this has become an extreme hassle trying to get the car back
and forth the last 5 times it has been to the shop it has broke down
before I could even get it home, trying to find rides and such. I just
want my car fixed properly. So I do choose to take it to a local shop
and not to Apex. I just don't have the time anymore.

have also contacted Modular SpeedWorx and told them the whole story and
waiting for a call back to see what it will cost to have the car fixed
by them. I have finally learned my lesson.
Yesterday when Mike took full responsibility on AIM, Jesse was standing
right behind me plus I have over a dozen people like yourself who know
how much of a pint he last few months have been because of there pore
quality of work.
Lets just say The Cobra will never see APEX again!

No I didn't, I know word of mouth
isn't as concrete as stone but its better then nothing. But I do have a
PM from him awhile go saying he would take full responsibility.
I just got off the phone with the owner of Modular speedworx and after

Craig, remember Mike was trying to sue the owners of Ca-F0rds.
Becareful bad mouthing Apex to another shop. I realise Modular was
doing it but you need to protect yourself against slander/lible as a
counter suit.

Yea I know, all I did was tell him
that I was tired of apex fucking up my car and what had happened since
day one leading up to today. Also the damage done to my polished parts,
and scuffs on the paint.

could pose a concern for our members. I am still waiting for his
response... We all have to relieze how dirty Mike can get... he can use
NorCalSVTOA site against us even Ban any of us for booting him as a
Vendor.. Even though he claims NorCalSVTOA isnt based from Apex we all
know it is,

can't Sue me for banning him off the site, that is at my discretion and
the discretion of the Mods. It states that in the Rules that he should
of read when he signed up... we did that to protect us.
I think the best thing to do is he only paid for 6 months to advertise
on the site after trying to tell me he deserved free banner space. Once
that is up we can pull him.

Here is his response even if some of it is a little fabricated:

That's fine we'll get the fenders fixed and we just need to come to an amount which is agreeagble for the head gaskets.
I am sorry you have been inconvienced with your car and hopefully
someone can do the repairs on the gaskets locally to you. We have
always bent over backwards for you and putting your car 1st over our
other customers. We have let you make payments on the repairs &
upgrades done to your car. I've helped you out with the insurance
company. Loaned you my car on numerous occassions. We have meet you
many times to help accomidate your schedule including Chris driving all
the way back from Monterey and skipping dinner with his mother on a
Saturday afternoon. We have come in on many nights and weekends to help
accomidate you. AND I have paid LOTS of overtime to my employees to
finish your car, including over $500 to tune your car with Ed. Many
times pushing back the promised finish times of cars scheduled before
yours.
I have even talked to manufacturers on your behalf to help you with discounted parts.
I am grateful you have helped promote Apex in a positive light and
helping send work to us. Unfortunately, I don't believe you look at the
whole picture alot of times... how many shops would charge you a labor
rate of $60 per hour, set you up with a Saleen 475HP blower for $3000,
get a complete body kit for less than $500.
I do feel conditions leading to the bursting of your overflow tank
helped contribute to the head gaskets bursting. I am not asking you to
pay the full amount to fix the problem because I do believe the hose
coming off conttibuted to it also. What I propose is you have AAA tow
the car to us and we will fix it for $500 which would include the parts
and costs of labor.
